An AI agent for WhatsApp is a system that talks to a company's customers and decides the next step of each conversation, following the rules and the information of the business. How the agent works within the rules
- Official WhatsApp API (WhatsApp Business Platform), with the rules on sending, consent and phone number quality defined by Meta.
- A customer service and sales agent for the business itself, a use that Meta allows. Meta's January 15, 2026 restriction on general-purpose AI assistants is suspended in Brazil by a decision of Cade, the Brazilian antitrust authority, upheld by its tribunal in March 2026. Cade treated the per-message fee that Meta created for those assistants as non-compliance with that decision and kept a daily fine in April 2026; the fee does not apply to a company's own customer service.
- Campaigns only for contacts who have agreed to receive messages.
- Handover to a person always available, with the rule defined during implementation.
- The agent does not make diagnoses, does not give legal advice and does not ask for data beyond what is necessary.
- Roles defined in the contract: your company is the data controller, and whoever processes the conversations on its behalf acts as the data processor, with a channel for requests from data subjects.
